Terms and Conditions
Thank you for choosing YaalaGo as your software as a service CRM tool. Please read these terms and conditions carefully before subscribing to our service. By subscribing to YaalaGo, you agree to these terms and conditions and our privacy policy.
1. Subscription and Refund Policy
a. Subscription Cancellation Policy: You may cancel your subscription at any time by managing your subscription on the subscription tab of your account. Cancellation will take effect at the end of the billing cycle, and no refunds or credits will be issued for any remaining days or months of your subscription. For yearly plans, there will be no refunds or credits issued. Access to the system will cease at the end of the billing cycle.
b. Payment: By subscribing to YaalaGo, you authorize us to charge your payment method for the subscription plan you have selected. You will be charged based on the pricing of the selected plan, which is subject to change. If you upgrade or downgrade your subscription plan, the price will be calculated based on what you have already paid. We reserve the right to cancel your subscription if we are unable to charge your payment method.
c. Enterprise Version: The enterprise version is capped at 50 users. Each additional user will be charged $39 per month for monthly subscriptions or $390 for yearly subscriptions.
2. Privacy Policy
a. Data Privacy: By subscribing to YaalaGo, you acknowledge and agree that we may collect and use your data to manage the system and provide service to you.
b. Data Collection and Use: We will collect your personal data for the purposes of providing our services to you, including processing orders, providing customer support, and billing. We may also collect non-personal data for analytical purposes. We will only use your data for the purposes for which it was collected and will not share it with any third parties, except as required by law or to provide service to you.
c. Data Retention: We will retain your personal data for as long as necessary to fulfill the purposes for which it was collected, unless a longer retention period is required by law.
d. Data Security: We take appropriate technical and organizational measures to protect your personal data against unauthorized or unlawful processing and against accidental loss, destruction or damage.
e. Data Breach Notification: In the event of a data breach, we will notify you as required by applicable laws.
3. Intellectual Property Rights
a. Ownership: YaalaGo owns all intellectual property rights in the service and its associated software, including but not limited to patents, copyrights, trademarks, trade secrets, and proprietary information.
b. Use of Service: You may not reproduce, distribute, modify, or reverse engineer any part of the service or its software without our prior written consent.
c. User Content: You are responsible for ensuring that any content you upload or share through YaalaGo does not infringe upon the intellectual property rights of any third parties.
4. User Responsibilities
a. Compliance: You are responsible for complying with all applicable laws and regulations related to your use of YaalaGo.
b. Accuracy of Data: You are responsible for ensuring the accuracy and completeness of any data you upload or share through YaalaGo.
c. Account Sharing: Sharing accounts is strictly prohibited and will result in termination of your license.
5. Indemnification
a. You agree to indemnify, defend and hold harmless YaalaGo and its affiliates, directors, officers, employees, agents, and licensors from and against any and all claims, damages, losses, liabilities, costs and expenses, including reasonable attorneys' fees, arising out of or in connection with your use of the service, your breach of these terms and conditions, or your violation of any applicable law or regulation.
6. Limitation of Liability
a. In no event shall YaalaGo or its affiliates, directors, officers, employees, agents, or licensors be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in connection with your use of the service, whether based on contract, tort, strict liability, or any other legal theory, even if YaalaGo has been advised of the possibility of such damages.
7. Termination
a. We reserve the right to terminate your subscription at any time and without prior notice, if you violate any of these terms and conditions.
b. Upon termination, you will immediately cease using the service, and we will delete or suspend your account and any data associated with it.
8. Service Level Agreement
a. We strive to provide a reliable and uninterrupted service to our users. However, we cannot guarantee 100% uptime and may need to perform maintenance or upgrades that result in temporary service disruptions.
b. In the event of such disruptions, we will notify you via email or our website.
9. Governing Law and Jurisdiction
a. These terms and conditions shall be governed by and construed in accordance with the laws of the jurisdiction in which YaalaGo is located, New York.
b. Any disputes arising out of or in connection with these terms and conditions shall be submitted to the exclusive jurisdiction of the courts of the jurisdiction in which YaalaGo is located, New York.
10. Modifications
a. We reserve the right to modify these terms and conditions at any time without prior notice.
b. Your continued use of YaalaGo after any such modifications will constitute your acceptance of the new terms and conditions.
